Situation in Libya at the International Criminal Court

The International Criminal Court’s Office of the Prosecutor plans to conclude its investigation in the Libya Situation by early 2026 – despite significant survivor and civil society concerns about this timeline, and despite the recent declaration by Libya’s Government of National Unity accepting the Court’s jurisdiction over all alleged Rome Statute crimes in the country between 2011 and 2027. Refugees in Libya and ECCHR urge the OTP to keep investigations open and address key accountability gaps, especially for crimes against migrants and refugees and for the role of EU and Member States officials in those crimes.
